Rape case: SC grants one week protection from arrest to Punjab MLA Simarjeet Singh Bains
New Delhi, February 3: The Supreme Court on Thursday directed the Punjab Police not to arrest for one week Lok Insaaf Party MLA Simarjeet Singh Bains, who is facing an arrest warrant in a rape case. The Supreme Court also rapped the Punjab Government and Lok Insaaf Party MLA Simarjeet Singh Bains over multiple cases filed against the woman, who accused the Punjab MLA of rape. The Bench also stayed all proceedings against Bains and the alleged rape victim. Also read | Covid-19 'less severe' in fully vaccinated people The Bench further directed the Punjab Police, Simarjeet Singh Bains and the complainant woman to file replies in the matter before the next date of hearing. The matter will be taken up for hearing next week. The court also questioned Bains' counsel that he has seen the attitude of his client, who is the MLA of two times. The court asked the Advocate General of Punjab what is happening in the state and how many cases did state file against that woman and said the state could not be a party to such "misuse of police machinery". During the hearing, senior advocate Mukul Rohatgi appearing for Bains, told the court that she is allegedly running fake job rackets for Canada. He told the court that his client is not behind any cases filed against her and the complaint has not been filed by him, but other people. Earlier, the Supreme Court had restrained the Punjab Government from arresting Lok Insaaf Party leader and Punjab MLA Simarjeet Singh Bains till Thursday (February 3) in the rape case. A Bench of Chief Justice of India NV Ramana and Justices AS Bopanna and Hima Kohli asked the Punjab Government not to arrest Simarjeet Singh Bains till Thursday and posted the matter for hearing on that day. Bains has challenged a Ludhiana court order which issued arrest warrants against him after he failed to appear in a case against rape allegations. During the hearing, senior advocate Mukul Rohatgi appearing for Bains had said the case of rape against his client, a three-time MLA from Punjab, was a bogus one and the petition to quash it was pending before the High Court.
