Punjab and Haryana HC rejects dismissed DSP Gursher Singh Sandhu's plea against FIR
PTC Web Desk: In a setback for dismissed Punjab DSP Gursher Singh Sandhu, the Punjab and Haryana High Court has rejected his petition challenging the investigation and FIR filed against him. The FIR was registered on October 15, following an inquiry initiated by the SP of Rupnagar, despite earlier findings clearing Sandhu by senior officials.
Gursher Singh Sandhu, who was posted as the DSP (Investigation) in Mohali, had filed the petition seeking the quashing of the FIR, arguing that the investigation should not have been handed over to a junior officer after both the SSP and Vigilance officials had concluded that there was no merit in the complaint against him.
The case dates back to an incident involving Baljinder Singh, a member of the Security Committee, who was assigned three security personnel. Sandhu, after assessing that there was no threat to Singh, recommended withdrawing the security personnel. This led Singh to file multiple complaints against Sandhu. Although the SSP of Mohali and Vigilance officials had cleared Sandhu of any wrongdoing, the case was later handed over to the SP of Rupnagar for further investigation. Based on this inquiry, an FIR was registered against Sandhu on October 15.
Sandhu argued that since the SSP had already conducted a thorough investigation and cleared him, it was unnecessary for a junior SP to re-investigate the matter.
It is also noteworthy that Gursher Singh Sandhu was recently dismissed from his position in connection with a separate investigation involving Lawrence Bishnoi's interview from jail.
The High Court, while rejecting Sandhu's plea, has allowed him to file a separate petition for quashing the FIR if he so desires.
