Uttarakhand becomes first state to implement UCC; Jan 27 to be celebrated as Uniform Civil Code day| Know key features

PTC News Desk: As Uttarakhand becomes first state in the country to enforce Uniform Civil Code, Chief Minister Pushkar Singh Dhami has announced that January 27 will be celebrated as Uniform Civil Code Day further adding that it is not it is not against any religion or sect, there is no question of targeting anyone.

Ascertaining the reasons behind excluding the Scheduled Tribes (STs), Uttarakhand CM said that tribes have been excluded to protect them and their rights under Article 342 of the Constitution.

What changes will take place after implementation of UCC ?

Addressing the event of the launch of UCC, CM Dhami stated, "Uniform Civil Code is a constitutional measure to end discrimination. Through this, an attempt has been made to give equal rights to all citizens. With its implementation, women's empowerment will be ensured in the true sense. Through this, evils like Halala, polygamy, child marriage, triple talaq etc can be completely stopped...We have kept our scheduled tribes mentioned under Article 342 of the Constitution out of this code so that those tribes and their rights can be protected...On this occasion today, I would like to clarify again that the Uniform Civil Code is not against any religion or sect, there is no question of targeting anyone."

Among various clauses is the significant one in which failure to declare live-in relationships or providing false information could result in imprisonment for up to three months, a fine of Rs 25,000, or both. A delay of even one month in registration could lead to a jail term of up to three months, a fine of Rs 10,000, or both.

Marriages must be registered, and the minimum marriage age will be 21 for men and 18 for women across all religions. This is intended to ensure individuals complete their education before marrying. Other key provisions include a ban on polygamy, child marriage, triple talaq, and a uniform process for divorce. The Code will not apply to Scheduled Tribes.

The Uniform Civil Code bans practices that some sections of Muslims follow when a woman loses her husband or gets divorced, including nikah halala and iddat.
