Dayan Krishnan: Top criminal lawyer who will lead NIA's prosecution against Tahawwur Rana
PTC Web Desk: As the legal spotlight turns toward the long-pending trial in the 2008 Mumbai terror attacks, one name has emerged as the driving force behind India's prosecution efforts—senior advocate Dayan Krishnan. A formidable presence in India’s criminal justice system, Krishnan is set to lead the National Investigation Agency’s (NIA) legal campaign in one of the country’s most high-profile terror cases.
Known for his razor-sharp arguments and deep understanding of international criminal law, Dayan Krishnan has built a stellar reputation over decades. A 1993 graduate from India’s first national law school and reportedly part of its inaugural batch, Krishnan began his independent legal practice in 1999. Since then, he has played key roles in several landmark cases, including the 2001 Indian Parliament attack trial and the highly sensitive Cauvery water dispute. His name also figures prominently in the Justice JS Verma Commission, formed in 1999 to recommend legal reforms.
Krishnan's prominence soared when he was appointed the Special Public Prosecutor in the 2012 Delhi gang-rape and murder case, where his courtroom advocacy contributed significantly to the pursuit of justice. His composure under pressure and ability to construct persuasive arguments have made him one of India’s most trusted legal minds in cases involving national security.
In the context of the 26/11 Mumbai attacks, Krishnan’s involvement is not new. He has been associated with the investigation since 2010, having played a crucial role in interrogating David Coleman Headley in Chicago as part of an NIA team. His grasp over the complexities of cross-border crime and extradition procedures has often given India the edge in international legal battles. He also represented India in other critical extradition cases, including those of Navy war room leak accused Ravi Shankaran and alleged paedophile Raymond Varley.
What sets Krishnan apart is his methodical approach to building legal arguments. During proceedings in international courts, particularly in matters relating to the 26/11 case, Krishnan’s insistence on the nature of charges—rather than the accused's past conduct—helped dismantle the defence’s claims around double jeopardy. His compelling arguments found favour across multiple judicial platforms, including the U.S. District Court and the Ninth Circuit Court of Appeals.
Joining him in the courtroom will be Special Public Prosecutor Narender Mann, a seasoned criminal lawyer with a history of representing the Central Bureau of Investigation in the Delhi High Court. The legal team also includes advocates Sanjeevi Sheshadri, Sridhar Kale, and counsel from the NIA.
With a track record built on experience, precision, and an unwavering commitment to justice, Dayan Krishnan now stands at the helm of one of the most important legal battles in recent Indian history.
